These Terms of Service (“Terms”) govern your access to and use of the website at [https://axion.ca] and any service offered by AXION Aerial Systems (“AXION”, “we”, “us”). By using the site you agree to these Terms.

1. Eligibility

You must be at least 18 years of age and legally able to enter into a binding contract.

2. Services

AXION offers (a) industrial drone services and (b) airframe rentals. Rentals are governed by a separate Rental Agreement in addition to these Terms.

3. Bookings and payment

  • All prices are in CAD and exclude applicable taxes (5% GST in BC unless otherwise noted).
  • Payment is processed by Square. By placing a booking, you authorize the charge per the booking summary.
  • Authorization holds may appear on your statement before final capture.

4. Cancellations and refunds

Free cancellation up to 48 hours before the rental start date. Cancellations within 48 hours forfeit [N]% of the rental total. No-shows forfeit the full amount. Refunds are issued to the original payment method within 7–10 business days.

5. Acceptable use

You agree not to:

  • Use the site or services to violate any law, including Transport Canada RPAS regulations;
  • Attempt to interfere with the site's operation or access non-public areas;
  • Reverse-engineer, scrape, or republish content without written permission.

6. Operator certification

You confirm that any pilot operating an AXION rental holds a valid Transport Canada RPAS Pilot Certificate of the appropriate class for the planned flight. AXION may require proof on demand.

7. Intellectual property

All site content, logos, and copy are owned by AXION or its licensors. You receive a limited, non-exclusive, non-transferable licence to view and use the site for its intended purposes.

8. Disclaimers

The site is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AXION does not guarantee uninterrupted availability.

9. Limitation of liability

To the maximum extent permitted by law, AXION's aggregate liability arising out of or relating to these Terms or the site shall not exceed the greater of (a) the amount paid by you to AXION in the [12] months preceding the claim, or (b) CAD [$XXX]. AXION is not liable for indirect, incidental, special, consequential, or punitive damages.

10. Indemnity

You agree to indemnify and hold harmless AXION, its directors, employees, and agents from any claim arising out of (a) your breach of these Terms, (b) your violation of law, or (c) your operation of an AXION rental.

11. Governing law and dispute resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. The courts of British Columbia have exclusive jurisdiction over any dispute, except that AXION may seek injunctive relief in any court of competent jurisdiction.

12. Changes

We may update these Terms. Continued use of the site after a material change constitutes acceptance of the revised Terms.
